1 Introduction

These Terms and Conditions ("Terms") govern your use of the website https://gocube.in and services provided by Gocube Solution India ("Company", "we", "our", or "us"), registered in Jaipur, Rajasthan, India.

By accessing our website, placing an inquiry, or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding. If you disagree with any part of these Terms, you may not use our services.

2 Our Services

Gocube Solution India provides the following professional digital services:

• Custom Website Design & Development
• SaaS Product & CRM Development
• UI/UX Design & Prototyping
• Search Engine Optimization (SEO)
• Digital Marketing & Growth Strategy
• Website Maintenance & Support

All services are provided on a project basis or retainer basis as agreed in writing. The scope of work, deliverables, timeline, and pricing will be defined in a separate Project Agreement or Proposal accepted by both parties.

We reserve the right to refuse service to anyone for any reason at any time. Service availability may vary and is subject to change without notice.

3 User Responsibilities

By engaging our services, you agree to:

• Provide accurate, complete, and timely information required for project delivery
• Supply all necessary assets, content, credentials, and approvals within agreed timelines
• Designate a primary point of contact authorized to make project decisions
• Not use our services for any unlawful, fraudulent, or harmful purpose
• Not attempt to gain unauthorized access to our systems, networks, or client data
• Comply with all applicable laws and regulations in your jurisdiction
• Not reproduce, resell, or redistribute our work without prior written permission

4 Payments & Refund Policy

Payment Terms:

• All projects require a minimum 50% advance payment before work commences
• Remaining balance is due upon project completion and before final delivery
• Monthly retainers are billed at the beginning of each billing cycle
• Invoices are due within 7 days of issuance unless otherwise agreed
• Late payments may incur a penalty of 2% per month on the outstanding amount

Refund Policy:

• The advance payment is non-refundable once work has commenced
• If we fail to deliver the agreed scope of work, a pro-rated refund may be issued at our discretion
• Refunds will not be issued for completed and delivered work that has been approved by the client
• Disputes must be raised within 7 days of delivery for resolution
• Subscription or retainer cancellations must be made with 30 days written notice

5 Intellectual Property

Upon receipt of full payment, the Client receives full ownership rights to the final deliverables created specifically for their project, including:

• Custom website design and code
• Custom graphics and visual assets created for the project
• Written content authored by Gocube Solution India for the project

Gocube Solution India retains ownership of:

• Pre-existing tools, frameworks, libraries, and code components used in development
• Internal methodologies, processes, and proprietary systems
• Portfolio rights — we reserve the right to showcase completed work in our portfolio unless the client requests confidentiality in writing

All third-party assets (fonts, stock images, plugins) are subject to their respective licenses. The client is responsible for obtaining necessary licenses for any third-party assets they request.

6 Limitation of Liability

To the maximum extent permitted by applicable law, Gocube Solution India shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of revenue, profits, data, or business opportunities
• Damages arising from third-party services, hosting providers, or platform outages
• Issues caused by client-provided content, assets, or decisions
• Security breaches resulting from client negligence or third-party actions

Our total liability for any claim arising out of or relating to our services shall not exceed the total amount paid by the client for the specific project in dispute.

7 Termination

Either party may terminate a project agreement under the following conditions:

• Client-initiated termination: Must be provided in writing. Any work completed up to the termination date will be billed and must be paid. Advance payments are non-refundable.
• Company-initiated termination: We reserve the right to terminate services if the client violates these Terms, engages in abusive behavior, or fails to make payments. In such cases, a pro-rated refund of unused advance payment may be provided.
• Mutual agreement: Both parties may agree to terminate with defined settlement terms.

Upon termination, all access credentials and partially completed work will be handed over to the client within 7 business days, subject to outstanding payment clearance.

8 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, specifically the laws applicable in the state of Rajasthan.

Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts located in Jaipur, Rajasthan, India.

We encourage resolving disputes amicably first. If a dispute cannot be resolved within 30 days of written notice, either party may pursue legal remedies available under Indian law.
